Public Agreement on the Provision of Online Booking and Sale of Bus Tickets Services

This Public Agreement (hereinafter the "Agreement") establishes the procedure for the provision and receipt of booking and ticket sales services, regulates the relationships between the Intermediary, the End Consumer, Carriers, and the Producers/Providers/Owners of third-party booking and sales systems. According to Article 633 of the Civil Code of Ukraine, this Agreement is a public contract.

Before using the website, please familiarize yourself with the Agreement.

The Agreement contains important information about the use of the Website and includes important information and warnings about the services you can receive through this Website. You agree to independently review this Agreement before each use of the Website. If you do not agree with the terms set forth in the Agreement, please do not use the https://leoway.com.ua/ website.

The public offer agreement, rules, and terms may change without prior notice. Changes take effect upon publication on the website.

Your booking and/or payment for a ticket is evidence of your unconditional acceptance of the public offer agreement and agreement with the rules and terms defined by the Website owner.

In this Agreement, the terms used have the following meanings:

End Consumer – an individual or legal entity directly using the service, work, goods, software, etc. implemented/sold through the Booking and Sales System.

Intermediary – JSC "LVIV ATP-14630" (EDRPOU Code 03114744), duly registered at the address: 79019, Ukraine, Lviv Region, city of Lviv, Horodnytska street, 47, providing booking services and other related services. The Intermediary carries out intermediary activities for booking tickets on international bus routes and provides other related booking services.

Carrier(s) – a legal entity or individual entrepreneur providing passenger and baggage transportation services by any means of transportation.

Producers/Providers/Owners – business entities that are the primary creators of services, works, goods, software sold via the Booking and Sales System.

Ticket (including electronic ticket) – a travel document of established form granting the passenger the right to receive bus transportation services, created in the Booking and Sales System – a computer program for online booking and sale of travel documents (tickets) for any type of transport, hotel rooms, insurance policies, and other services directly or indirectly related to spatial movement, the rights to which belong to JSC "LVIV ATP-14630".

GENERAL PROVISIONS

The Intermediary conducts business activity through the website domain https://leoway.com.ua/

This Agreement is a public offer (official proposal) of the Intermediary. According to paragraph 2 of Article 642 of the Civil Code of Ukraine, if the below conditions are accepted and the services paid for, the legal or physical person who does so becomes the Buyer. This Agreement can be concluded (accepted) by the End Consumer by submitting an application for booking and/or purchase of international bus transportation services and payment in favor of the Carrier. By booking and/or purchasing a Ticket, the End Consumer confirms full understanding and acceptance of this Agreement's terms.

The End Consumer and the Intermediary are aware of the general requirements for contract conclusion necessary for the validity of the transaction, possessing full civil and legal capacity, and having respective powers for contract conclusion. They fully realize the meaning of their actions and freely express will conforming to the internal will of the parties, aiming for actual legal consequences and understanding their rights and duties under the Agreement. They conclude this Agreement accordingly.

 

SUBJECT OF THE AGREEMENT

1.1. Under the terms of this Agreement, the Intermediary undertakes to provide the End Consumer with services to search for the appropriate Carrier according to the date, time, and direction chosen by the End Consumer, to form transfers of various Carriers, to enter into a carriage contract by booking a Ticket, to issue Tickets of different Carriers in one order, pre-sale of tickets, seat reservations, ticket ordering by phone, Ticket reissuing, searching for optimal schedule upon End Consumer's request, service support including customer support, additional services upon request, as well as advance payment by the End Consumer for the Ticket (hereinafter Services), and the End Consumer agrees to pay for services directly to the Intermediary.

1.2. The End Consumer intends to use booking services for international and domestic bus transportation.

 

RIGHTS AND OBLIGATIONS OF THE PARTIES

2.1. The End Consumer has the right to:

Receive services under this Agreement;

Use the Ticket in accordance with the chosen date, time, departure place, and chosen Carrier;

Return the Ticket under terms specified by the Carrier and/or JSC "LVIV ATP-14630";

Demand compensation for damages based on this Agreement by submitting claims to JSC "LVIV ATP-14630".

2.2. If moral damage is caused to the End Consumer by actions or inaction of JSC "LVIV ATP-14630", the compensation amount shall not exceed the Ticket price.

Note: Some Carriers require ticket exchange/return only at ticket offices without refunds online or at partner offices of JSC "LVIV ATP-14630". Terms of such exchange/return are indicated in the Ticket.

2.3. The End Consumer is obligated to:

Prepay 100% of the Ticket price as stated on the Website or reserve it per Booking rules;

Check date, time, departure and arrival city/place immediately after Ticket purchase;

Arrive at the departure point at least 30 minutes before bus departure;

Notify JSC "LVIV ATP-14630" if unable to use the Ticket for any reason;

Familiarize with Ticket return conditions;

Contact JSC "LVIV ATP-14630" before Ticket payment if return conditions of chosen Carrier's Ticket on the Site are unavailable.

2.4. JSC "LVIV ATP-14630" has the right to:

Act on behalf of the Carrier within powers defined by contractual relations;

Conclude carriage contract with the End User per Carrier terms and methods;

Establish and receive additional fees from the End Consumer for additional services;

Record phone calls with the End Consumer during service center contacts or for necessary Ticket-related information.

2.5. JSC "LVIV ATP-14630" is obliged to:

Timely notify the Carrier of purchased Tickets and additional paid services;

Send Tickets to the End Consumer per Carrier’s established form;

Transfer payments received from the End Consumer for Tickets to the Carrier’s account;

Notify of changes to service conditions (if informed by the Carrier);

Notify of route changes or cancellations (if informed by the Carrier);

Accept and process End Consumer claims or forward to respective Carrier;

Timely notify the End Consumer about claim consideration and results, including Carrier responses.

2.6. JSC "LVIV ATP-14630" responds to claims via the channel used to receive them and does not disclose replies to third parties, including the End Consumer’s requests.

 

PAYMENTS

3.1. Payments are made cashless in any currency per Ukrainian law.

3.2. The final sale price includes costs established by the Producer/Provider/Owner, Intermediary service fees, payment system fees, and third-party booking and sales system fees.

3.3. Costs related to processing fees, currency conversions etc. are borne by the End Consumer.

3.4. Amounts exceeding sums to be transferred to the Intermediary belong to the End Consumer.

3.5. Funds received by the Intermediary less commissions shall be forwarded per existing obligations; these are transit funds and do not affect financial results.

3.6. Bank service fees related to payment transfers shall be paid by the initiating Party.

 

CONSENT TO PERSONAL DATA PROCESSING

4.1. The End Consumer consents and confirms the accuracy of data provided during booking/purchasing and agrees to continue processing and storing that data, including but not limited to transferring to third parties related to this Agreement execution, status notifications, order processing, promotional communications, in accordance with current legislation.

4.2. Parties agree to protect personal data from unauthorized access and use according to national and international laws.

 

LIABILITY OF THE PARTIES

5.1. Parties are liable for breach or improper performance of the Agreement under Ukrainian law.

5.2. Breach means failure or improper fulfillment of obligations.

5.3. Liability is exempted if breach occurred without fault (intent or negligence).

5.4. The Party is not liable if proper measures to fulfill obligations were taken.

5.5. The guilty Party compensates damages, including lost profits, as per law.

5.6. The End Consumer is personally responsible for compliance with Carrier’s rules and website usage.

5.7. The End Consumer bears sole responsibility for failure to provide truthful information, including on their own or on behalf of others.

5.8. This Agreement regulates booking and Ticket purchase only, which is the carriage contract evidence.

 

PERSONAL DATA

6.1. Parties mutually consent to personal data collection, processing, disclosure, and storage in electronic or paper forms including identifiers, contact details, tax info, and any other data required by law for the Agreement performance.

6.2. Parties commit to guarantee protection of such data from unauthorized processing or access.

 

FORCE MAJEURE

7.1. Parties are exempt from liability for failure or improper fulfillment of obligations caused by force majeure events beyond their control, including war, military actions, embargoes, natural disasters, epidemics, quarantine, acts of terrorism, strikes, etc.

7.2. The affected Party must notify the other Party within 3 business days of occurrence.

7.3. Force majeure shall be certified by the Chamber of Commerce or regional equivalent.

7.4. Upon confirmation, obligation terms are extended accordingly.

7.5. If force majeure lasts more than 3 months, either Party may unilaterally terminate the Agreement with 10 days' notice without liability.

7.6. Failure to notify disables right to claim force majeure.

7.7. If force majeure persists longer than 2 months, Parties negotiate alternative fulfillment.

 

DISPUTE RESOLUTION

8.1. All relations arising from or related to this Agreement governed by Ukrainian law.

8.2. Disputes resolved by negotiation or court if agreement fails.

 

TERM OF AGREEMENT

9.1. Effective upon signing, valid for one calendar year.

9.2. Automatically renewed unless notified 30 days prior intent to terminate.

 

WARRANTIES

11.1. Purchasing through the Website confirms End Consumer’s legal capacity and consent to data processing.

11.2. End Consumer agrees to pay ticket prices and applicable taxes on all purchases.

11.3. End Consumer agrees to pay due amounts if payment is not made or is rejected/returned by bank.

11.4. Intermediary confirms rights to sell Tickets per Carrier terms.

11.5. Intermediary reserves right to block suspicious credit/debit cards.

 

COPYRIGHTS

12.1. Website content including names, logos, trademarks, texts, images and others protected by copyright belonging to JSC "LVIV ATP-14630" or third parties.

12.2. End Consumer may not use website content except as permitted.

12.3. Intermediary makes no warranty of non-infringement but reserves all rights.

12.4. Unauthorized use of intellectual property or system security breaches are violations.

 

MISCELLANEOUS

13.1. Agreement number matches Ticket number.

13.2. Agreement date is Ticket payment date.

13.3. In all other respects governed by Ukrainian law.

13.4. This Agreement is integral and supersedes previous agreements.

13.5. Communications in electronic form have equal legal force as written documents.
